Privacy Policy

Your privacy is important to us. That's why we've designed the TopSelf.io Action Tracker to run locally on your device, and not our servers, or a 3rd party's.

Bastion Consulting Inc, the maker of the TopSelf.io framework, and Action Tracker App, respect your privacy. This Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to the practices described in this Policy.

1. Data Collection

We do not collect, transmit, or store any personal data or user content. All data processed by the App remains locally on your device and is not uploaded to any external servers or cloud services controlled by us.

Specifically:

  • No registration is required to use the App.
  • We do not collect your name, email address, device ID, IP address, or any other personal information.
  • We do not use analytics tools, or advertising networks.
  • We do not access your contacts, location, or media files unless explicitly required by the App's features, and only with your permission.

2. Local Device Permissions

Some features of the App may require access to features of your iPhone, such as:

  • Local storage (for saving files/data)
  • Share features

These features are used solely on your device and are never shared or transmitted without your permission.

3. GDPR Compliance (for EU/EEA Users)

As the App does not collect or process personal data, the obligations under the General Data Protection Regulation (GDPR) do not apply in full. However, we respect your right to privacy. You are in full control of your data on your device and can delete it at any time by uninstalling the App or clearing the data through your iPhone settings.

4. CCPA Compliance (for California Residents)

In accordance with the California Consumer Privacy Act (CCPA), we do not collect personal information, sell data, or share data with third parties. Since no data is collected or stored by us, there is no data to disclose, sell, or delete under the CCPA.

5. Children's Privacy

The App is not intended for use by children under the age of 13. However, because the App does not collect, transmit, or store any personal information — and all data remains solely on the user's device — we do not have access to any information, including from children.

As a result, we cannot access or delete data created or stored locally by users, regardless of age. If you are a parent or guardian and you are concerned about your child's use of the App, we recommend supervising their use or uninstalling the App from the device.

7. Apple App Store Terms

These Terms are between you and Bastion Consulting Inc., not Apple Inc. You acknowledge that Apple is not responsible for the App or its content. Your use of the App must comply with the Apple Media Services Terms and Conditions.

You acknowledge and agree that Apple has no obligation to furnish any maintenance or support services with respect to the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple shall have no other warranty obligation whatsoever with respect to the App.

You acknowledge and agree that Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:

  • Product liability claims
  • Any claim that the App fails to conform to any applicable legal or regulatory requirement
  • Claims arising under consumer protection or similar legislation

You and Bastion Consulting Inc. acknowledge and agree that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Bastion Consulting Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country
  • You are not listed on any U.S. Government list of prohibited or restricted parties

You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

8. End User License Agreement

This End User License Agreement ("EULA") is governed by the Apple Media Services Terms and Conditions and includes the standard EULA provided by Apple unless you enter into a separate agreement with us. 9. Data Control and Processing

The App operates entirely on-device and does not transmit any user data to our servers or third-party services. As such, we are not a 'controller' or 'processor' of personal data as defined by applicable privacy laws.

As we do not collect or store personal data, requests under GDPR such as access, correction, deletion, or data portability must be managed directly by the user via device settings or by uninstalling the App. We do not have access to perform these actions on your behalf.

The App does not knowingly collect any personal information from children under the age of 13. If you believe that a child has provided personal information to us, please contact us so that we can take appropriate action.
